By accessing or using MotionEver ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to all users, including visitors, registered users, and paying subscribers.

2Description of Service

MotionEver is a screen recording and AI-powered video editing platform. It allows users to record their screen, edit recordings with timeline effects, add captions, and export polished videos.

The Service is available as a desktop application (Electron) and a web application. Features may differ between platforms.

3Accounts & Registration

• You must be at least 13 years old to create an account
• You are responsible for maintaining the confidentiality of your login credentials
• You may not create accounts on behalf of others without their permission
• One person may not maintain more than one free account
• You must provide accurate information during registration

4Acceptable Use

You agree not to use MotionEver to:

• Record or distribute content you do not have the right to record
• Violate any local, national, or international law or regulation
• Infringe on the intellectual property rights of others
• Record, store, or distribute content that is illegal, hateful, or harmful
• Attempt to reverse engineer, decompile, or bypass the software's security
• Use the Service for automated bulk recording without prior written consent

5Intellectual Property

The MotionEver name, logo, design, and software are the intellectual property of MotionEver and are protected by copyright and trademark laws. You may not use our branding without written permission.

The underlying open-source components of MotionEver are subject to their respective open-source licenses.

6Your Content

You retain full ownership of all recordings and videos you create with MotionEver. We do not claim any rights over your content.

By uploading content to MotionEver's cloud storage, you grant us a limited, non-exclusive licence to store and serve that content solely for the purpose of providing the Service to you.

You are solely responsible for ensuring that your content does not violate any laws or third-party rights.

7Plans & Billing

• Free plan — limited features and storage, no payment required
• Pro Monthly — billed monthly, cancel anytime
• Lifetime — one-time payment, permanent access

All payments are processed securely through our payment provider. We do not store your card details.

Refunds are offered within 14 days of purchase if the Service does not work as described. Contact support@motionever.com to request a refund.

8Disclaimers

The Service is provided "as is" without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

We are not responsible for any data loss resulting from technical failures. We recommend keeping local backups of important recordings.

9Limitation of Liability

To the maximum extent permitted by law, MotionEver shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, loss of revenue, or loss of profits.

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10Termination

You may delete your account at any time from Account Settings. Upon deletion, your data will be permanently removed within 30 days.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice.

11Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the new Terms. We will notify you of significant changes via email or in-app notice.
